Registration

To use the service, a parent must create an account. A valid email address is required for this, and you confirm that you are an adult and a parent or legal guardian by entering the year of birth and answering a security question. You also need to enter the child's given name. Additional children profiles can be added to the parent account later. You will receive an email with a temporary password. By logging in with the email address and this password, you consent to the processing of your data and the data of your children.

Paid services

The use of DiGiKiNDi in the basic version is free and financed by advertising in areas of the app that are primarily aimed at parents. You have the option to sign up for a so-called SuperParent subscription. This will give your children 2 extra puzzle pieces per day for the jigsaw puzzle of the month. In addition, the advertising on the parent board will be removed. The SuperParent subscription is linked to your Google Play account and not to your DiGiKiNDi account. In-app purchases and subscriptions such as the SuperParent subscription are billed through Google Play. The provider is Google Ireland Limited. Licenses

All property rights associated with DiGiKiNDi belong to Dr. Lukas Twardon. You are not allowed to use the logos, brands, domains, and other intellectual property without my explicit permission. But I do not claim ownership of the content you share on DiGiKiNDi (images, voice messages, texts). You must own the rights to this content. You grant me a royalty-free license to use, reproduce, modify, distribute, and display the content. However, this license is limited to the purpose of operating and providing the service. In the event of infringement of third party intellectual property, I may take action such as deleting content or disabling or deleting the account. You may report infringements by sending an email to mail@digikindi.com.

Acceptable use

You may use DiGiKiNDi only in accordance with these terms of use. Otherwise, I may take action such as disabling or deleting your account. Note that these terms of use only apply to DiGiKiNDi itself. For example, if you share an invitation code via an external service, the terms and conditions of that service will apply. You are responsible for the security of your account and password and must notify me of any unauthorized access or security breaches. You are prohibited from distributing malicious computer code through DiGiKiNDi, disrupting the service by overloading it or otherwise, automatically creating accounts or profiles, automatically distributing content, copying the service, reselling it, or making it available to unauthorized third parties, attempting to gain unauthorized access to the system or user data, or otherwise causing or attempting to cause harm to DiGiKiNDi or its users.

Unacceptable content

When using DiGiKiNDi, you should always keep in mind that it is a platform for families and children. You are responsible for the content you share. If you share unacceptable content, I may take action such as deleting that content or disabling or deleting your account. In particular, sharing the following content is prohibited:

• insults or false statements of fact about third parties
• illegal, pornographic, threatening, harassing, violence-glorifying, discriminatory, or racist content
• pictures of other persons without the consent of the person or (in the case of children) the parents
• content that violates the privacy rights of others
• content to which you do not have usage rights
• content that is not appropriate for children or even harmful to minors

Indemnification

If a claim is made against me by a third party based on your actions or content on DiGiKiNDi (in violation of applicable law or these terms of use), you indemnify and hold me harmless from and against all liabilities and damages (including court costs and attorneys' fees) to the fullest extent permitted by law.

Disclaimer

I do my best to provide you with my services and hope that they are useful and safe. However, you use them at your own risk. I provide the service on an as is and as available basis. This means that I cannot guarantee that DiGiKiNDi will always fulfill its purpose and function securely, error-free, and without interruptions or delays. I am also not liable for any defects, loss of data, or damage to your devices that may occur as a result of using the app. The exclusion of liability does not apply in case of injury to health, body, or life as well as in case of intentional or grossly negligent conduct. I am also liable for the violation of essential obligations arising from the legal relationship with the user (cardinal duties). In this case, liability is limited to the amount of typically foreseeable damage.

Termination

You can terminate your account at any time as described in the FAQ. I may also disable or delete your account if I believe that you are violating these terms of use, causing harm, or posing a risk to DiGiKiNDi or its users.

Dispute settlement

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. I am not willing or obliged to participate in dispute resolution procedures before a consumer arbitration board. German law applies, unless you would be deprived of the protection granted by mandatory consumer protection provisions of the country in which you have your habitual residence.

Changes to the terms of use

I reserve the right to update or modify these terms of use as required. The current version is always available in the DiGiKiNDi app and on the website. If necessary, I will notify you of substantial changes via email and/or push notification and notice on the parent board in the app. You are responsible for checking your email and parent board notices regularly. Changes will take effect 30 days after notification. Your continued use of DiGiKiNDi after this period confirms your acceptance of the modified terms of use.
